Your Tax Negotiator must have experience negotiating with the IRS for you to get the best results negotiating tax debt, unfiled tax returns or other tax problems because IRS tax negotiation is part art and part science.

The IRS won't even talk to you or your professional tax negotiator about any kind of negotiation until after you are "fully compliant". Compliant usually just means that your tax returns need to be filed.

You may not realize it but the IRS may have filed returns for you. These returns are called Substitute For Return or SFRs. When the IRS files returns for you the tax is almost always higher than if you had filed the returns yourself. As your tax negotiator I almost always request the IRS to reconsider SFR returns by filing new returns for you. This can substantially reduce your tax.

Because the IRS requires unfiled returns be filed to enter into a negotiation and because re-filing SFRs saves you a bundle, I get you caught up on filing your back taxes before I even attempt to negotiate. After you are compliant we can begin negotiations to improve your situation.

How do we get started?

You have to initiate contact with me by telephone because the best way to start is with a conversation. Your initial call if free and it is very easy because you simply tell me about your problem.

The key points of our conversation need to include:

Step 1:

  • What tax years have not been filed?

  • Has the IRS filed SFRs for you? (You may not know, but I can find out for you.)

  • How much money do you owe for each year and for these years that you do owe money, when did you file the returns? (You may not know but I can find out for you.)

  • Tell me about the history of your tax case and any prior IRS negotiations and settlements, for example have you had an Installment Agreement or Offer in Compromise with the IRS before?

  • I will answer any questions you have about your tax situation.

  • The best solution for you may be obvious. If the solution is not clearly determinable we will schedule a solutions appointment and at that time we can discuss your options.

  • You decide to either get started now, wait for a solutions appointment, or do nothing. If you need immediate attention you will want a professional tax negotiator to get started immediately.

Step 2:

To get started
I will send you (usually by email attachment but this can be done by fax and snail mail):

  1. An IRS Form 2848 Power of Attorney which the IRS requires your tax negotiator to have on file with the IRS.

  2. A Working Agreement which simply states in writing the key points of our telephone conversation such as: What I will do. What you need to do. How long it will take. My fee and payment terms if we know at that point what needs to be done, otherwise we wait until a complete solution to your problem is found and an action plan developed. Finally, any other issues specific to your case.

I can usually get started immediately because the signed documents and an initial payment can be returned to me electronically. 

You will find the process of getting started to be very quick and simple because you may need something done fast to remove a levy or garnishment.

Step 3:

I fax your signed Power of Attorney to the IRS. If your case requires immediate action I call the IRS and fax the Form 2848 to the person I am talking to.

I also order your Account Transcript and your Wage & Income Transcript. This usually takes about 48 hours, sooner in emergency situations. Upon receipt of your transcripts I review them and if necessary schedule key points. This helps in developing your plan because we are assured that we have all the information the IRS is using.

Step 4:

How Long Does Negotiation Take?

Usually, it is possible to have your levy or wage garnishment stopped immediately within a day or two, which is before we start negotiating your tax or your payment amount because initially, in most cases there are ways to buy some time before we negotiate.

I do have to give the IRS assurances that we are working on completing your returns and provide the IRS with a timetable. This is just one example of something that I can do for you that you can't do for yourself. The reason is because if your credibility with the IRS has been compromised they are less likely or unwilling to cooperate but I do have excellent credibility because they know my track record in dealing with them and they know I will do the things that I say I will do. Because of this I can get things done FAST.

There is much more to the science of negotiating than filing returns because of the complexity of IRS procedures which prescribe the rules the IRS must follow in negotiating your taxes. Many of these rules can be found in the IRS Internal Revenue Manual. Other rules can be found in IRS Letter Rulings, and tax law. If your tax negotiator is to provide optimum results for you they must be intimately familiar with the rules and procedures that will determine the outcome of your case.

The art of tax negotiation depends a lot on the mix of your tax circumstances and the ways to use IRS internal systems and procedures to your maximum advantage. Your tax negotiator must know who to talk to at the IRS and who not to talk to, and what to say and what must not be said. Where is the line between right and wrong? Are we working in a legally gray area of the tax law? There are some skills that can only be gained from working in the trenches, negotiating all kinds of different problems.
